Offer of Energy Gate Europe Sp. z o.o. for the sale of gaseous fuel through a standby seller for high-methane natural gas (“E”) (hereinafter: “Offer”) Acting pursuant to Article 5aa of the Energy Law of 10 April 1997 (i.e. Journal of Laws of 2019, item 755, as amended) Energy Gate Europe Sp. z o.o. (hereinafter: “Seller”) a comprehensive service for the sale and distribution of gaseous fuel including provisions for the sale of reserve gaseous fuel (high-methane natural gas “E”) to End Customers (hereinafter: “Customer”) who are not household customers, connected to the distribution network of National Operator of the Gas Distribution System in Poland – Polska Spółka Gazownictwa Sp. z o.o. (hereinafter: “DSO”). The Reserve Seller’s task is to ensure deliveries of gaseous fuel to the final customers in case when the seller selected by the customers ceases to perform the comprehensive agreement or the provisions of the gas sales agreement or the comprehensive agreement (hereinafter referred to as the ‘Agreement’) with the previous seller have expired. This offer takes into account the following conditions of standby sales:
The Customer indicates the Seller as a standby seller and authorizes the DSO to conclude a standby sale agreement in its name and on its behalf or a comprehensive agreement containing the provisions of a standby sale agreement in case of the occurrence of the circumstances mentioned above. The statement mentioned above shall be submitted to the address email@example.com .
In order to ensure continuity of Gas deliveries the DSO shall conclude a standby sale agreement or a comprehensive sale agreement including provisions of the standby sale agreement (hereinafter referred to as the “Standby Agreement”) in the name and on behalf of the Customer with the Seller, under the conditions specified in the model Standby Agreement, according to the Price List for Standby Sale (hereinafter referred to as the “Price List”), in accordance with the Offer. The Standby Agreement shall be valid as of the date of discontinuance of the Existing Agreement and shall be concluded for an indefinite period of time, taking into account:
Transfer of contractual capacity (throughput) from the Existing Seller to the Seller, taking into account the conditions of distribution of the Gaseous Fuel at a given exit point from the OSD gas network, where the supply of gaseous fuel to the Customer has been discontinued;
Until a new statement is received from the End User, the determination and settlement of the rate of the Energy Efficiency Certificate and the excise duty for heating purposes will be calculated in the full amount;
The settlement of gas distribution is made in accordance with the DSO Tariff published in the bulletin of the President of the Energy Regulatory Office.
